1. Acceptance of Terms

By downloading, installing or using the HelloMyGYM mobile application or accessing our website, you agree to be bound by these Terms & Conditions, our Privacy Policy and any other policies notified within the app. If you do not agree, you should not use the app or services.

2. Eligibility & Accounts

HelloMyGYM is intended for use by gym owners and authorised staff in India. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate, complete and up-to-date information at all times.

3. Service Description

HelloMyGYM provides tools to manage gym members, staff, attendance, payments, expenses and reports. We may add, modify or remove features from time to time to improve the service. While we seek to keep the service reliable, we do not guarantee uninterrupted or error-free operation.

4. Subscriptions, Pricing & Payments

Certain features of HelloMyGYM are available on a paid subscription basis. All prices are generally quoted in Indian Rupees (INR) and may be subject to applicable taxes. Payments are processed securely through Razorpay or other approved payment partners. By initiating a payment, you authorise us and our payment partners to process the transaction in accordance with applicable laws.

5. Payment Gateway (Razorpay)

We use Razorpay as our primary payment gateway. When you make a payment, you may be required to provide debit/credit card, UPI, wallet or net-banking details on Razorpay's secure interface. Those details are handled and stored by Razorpay and/or its banking partners, not by HelloMyGYM. We only receive limited information such as payment status, amount, time and a masked identifier to activate or renew your subscription.

6. Refunds & Cancellation

Our Refund & Cancellation Policy is explained in a separate document available on this website. By using HelloMyGYM and making a payment, you agree to that policy. In summary, we offer a 7-day money-back guarantee for new subscriptions. After this 7-day period, subscriptions are typically non-refundable except in cases of duplicate charge or genuine technical error. Any eligible refunds will be processed back to the original payment source via Razorpay.

7. Use of the App

You agree not to misuse the app or use it for any unlawful, harmful, fraudulent or unauthorised purpose. You are solely responsible for the accuracy of data entered for your gym, members and staff. You must ensure that you have the necessary rights and consent to store and process member and staff information in HelloMyGYM.

8. Data Protection & Privacy

Our handling of personal data is described in detail in the HelloMyGYM Privacy Policy. By using the app, you acknowledge that you have read and understood that policy. You agree not to upload sensitive personal information unless strictly necessary and permitted under applicable laws.

9. Third-Party Services

The app may integrate with third-party services such as Razorpay, cloud hosting providers, communication tools or analytics services. Your use of such services may be subject to their own terms and policies. We are not responsible for the content, availability or practices of these third parties.

10. Limitation of Liability

To the maximum extent permitted by law, HelloMyGYM and its team shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of revenue, profits, data or goodwill arising out of or in connection with your use of the app or website. Our total aggregate liability for any claim shall be limited to the subscription fee paid by you for the current active period, if any.

11. Termination

We may suspend or terminate your access to HelloMyGYM at any time if we reasonably believe that you have violated these Terms, misused the service, or if required by law. You may also stop using the app at any time. Upon termination, certain obligations such as outstanding payments and legal duties may continue to apply.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with the use of HelloMyGYM shall be subject to the exclusive jurisdiction of the competent courts within India.
